What To Do When Detained Or Arrested During An Immigration Raid

A number of our clients have expressed growing concern regarding the recent Immigration Raids by ICE. Here is a list of some important points to keep in mind. Remember: always speak to an experienced immigration attorney when confronted with the possibility of detention.

Be Prepared
• If you are in a valid status always carry the documents with you.
• If you are undocumented print out the Red Card from ilrc.org. This Card lists your constitutional rights and will inform the arresting immigration/police official that you are aware of your rights and wish to exercise them.
• Carry the name and the phone number of a reliable immigration attorney.
• If you have an Alien Registration Number carry a copy of it with you at all times.
• If you have an Alien Registration Number or any other immigration papers keep copies at home and let your family members know their whereabouts.

When detained/arrested
• Show the Red Card to an immigration/police official. Please print one from ilrc.org.
• You do not have to answer any questions asked by the immigration/police official.
• Do not tell the immigration/police official your country of origin, nationality or immigration status.
• Ask to speak to an immigration attorney.
• Do not sign any papers. Even when an officer tries to convince you to do so.
• Do not carry with you and NEVER present any false documents.
• Do not lie about your name.
• Stay calm and do not try to run away.
• If you have children at school ask the immigration/police official to let you make arrangements for them.
• Find out the name of the agency that detained/arrested you.
• Should immigration/police come to detain/arrest you at your home/apartment do not let them in unless they present a valid warrant with your name on it that is signed by a judge. Ask them to put it under the door and inspect its validity.
